Terms of use

1. Purpose
These Terms of Use govern access to and use of the SBMA France digital platform ("the Platform"), available at sbma-france.org. The Platform is operated by SBMA France, a non-profit association (RNA W604009961 — SIREN 103 219 770), registered at 6 avenue du Poteau, 60300 Chamant, France.
2. Access to the Platform
Access to the member area is reserved for healthcare professionals and members of the SBMA France association. Creating an account requires: (a) being a qualified healthcare professional or student in healthcare training, (b) providing a valid RPPS number, (c) consenting to these Terms of Use and the privacy policy. SBMA France reserves the right to refuse or deactivate an account without having to justify its decision.
3. User obligations
The user agrees to: (a) provide accurate and up-to-date information, (b) maintain the confidentiality of their credentials, (c) use the Platform solely in the context of SBMA France activities, (d) not impersonate another member or healthcare professional, (e) immediately report any fraudulent use of their account to contact@sbma-france.org.
4. Content and intellectual property
All content published on the Platform (texts, images, data, logo) is the exclusive property of SBMA France or their respective authors. Any reproduction, modification or commercial exploitation without prior authorisation is prohibited. Users authorise SBMA France to use their profile information for internal purposes (mission coordination, association communications).
5. Mission applications
Submitting an application for a mission via the Platform constitutes an expression of interest and not a contractual commitment. SBMA France reserves the right to select participants according to each mission's needs (required specialty, available places, availability). The acceptance or rejection of an application is at the sole discretion of the association's board.
6. Second medical opinions
The second medical opinion feature is reserved for active members. Any request for a second opinion must comply with the ethical rules applicable to healthcare professions. Medical documents transmitted are encrypted (AES-256) and stored on HDS-certified infrastructure. SBMA France does not guarantee a response time. The opinion provided constitutes a complementary medical opinion and not a primary medical act.
7. Personal data
The processing of personal data is governed by the Privacy Policy available at /en/confidentialite. In accordance with the GDPR, the user has the right to access, rectify, erase and port their data, exercisable at contact@sbma-france.org.
8. Limitation of liability
SBMA France strives to ensure the availability of the Platform but cannot guarantee uninterrupted access. The association shall not be held liable for direct or indirect damages resulting from a service interruption, data loss or fraudulent use of an account by a third party.
9. Changes to the Terms
SBMA France reserves the right to modify these Terms of Use at any time. Users will be notified by email of material changes. Continued use of the Platform after notification constitutes acceptance of the new Terms.
10. Applicable law and disputes
These Terms of Use are governed by French law. In the event of a dispute, an amicable resolution will be sought before any legal action. Failing that, the competent courts in the jurisdiction of SBMA France's registered office (Oise, France) will have jurisdiction.
